Terms and Conditions

By registering with our company, Dipex Lettings and Management Limited, you acknowledge and agree to the following terms and conditions:

1. Registration  Accuracy: When registering, you must provide clear and accurate information about your circumstances. We may ask for details regarding your credit status, employment information, and salary to ensure that you meet the criteria set by our referencing company. It is essential that you provide truthful information as affordability will be determined based on your income. Failure to provide accurate information may result in disappointment or the loss of fees if your application is unsuccessful due to reference failure.

2. Holding Deposit (per tenancy) – One week’s rent: This amount is required to reserve a property. Please note that the holding deposit will be withheld if any relevant person, including guarantors, withdraws from the tenancy, fails a Right-to-Rent check, provides materially significant false or misleading information, or fails to sign the tenancy agreement (and/or Deed of Guarantee) within 15 calendar days or any other mutually agreed deadline.

3. Security Deposit (per tenancy):
– Rent under £50,000 per year: Five weeks’ rent. This deposit covers damages or defaults on the part of the tenant during the tenancy.
– Rent of £50,000 or over per year: Six weeks’ rent. This deposit covers damages or defaults on the part of the tenant during the tenancy.

4. During Your Tenancy:
– Unpaid Rent: If rent is more than 14 days in arrears, interest at 3% above the Bank of England Base Rate will be charged until the rent is paid.
– Lost Keys: Tenants are responsible for the actual cost of replacing lost keys or security devices. If the loss requires locks to be changed, the tenant will be liable for the actual costs of a locksmith, new lock, and replacement keys for themselves, the landlord, and any other individuals requiring keys.

5. Variation of a Tenancy: A fee of £50.00 (including VAT) per request will be charged to cover the costs associated with taking the landlord’s instructions and preparing and executing new legal documents.

6. Ending Your Tenancy:
– Early Termination: If you wish to leave the contract early, you will be responsible for the landlord’s costs in re-letting the property. These costs will not exceed the maximum amount of rent outstanding on the tenancy. Additionally, an Early Termination fee of £270.00 (including VAT) per tenancy will be payable to cover the landlord’s costs in referencing new tenants and producing new tenancy agreements.

7. Property Management:
– Responsibility: At the start of the tenancy, we will inform you who is responsible for managing the property. If Dipex Lettings and Management Limited is not managing the property, we cannot authorize repairs or maintenance or guarantee the speed of repairs. If we manage the property and hold keys, we may provide access to contractors with your permission. However, if we do not hold keys or the contractor is unwilling to collect keys, it is your responsibility to provide access.

8. Insurance: It is your responsibility to insure your own belongings throughout the tenancy. We highly recommend that all tenants take out contents insurance to protect their belongings. When applying for a tenancy, tenants may be contacted by one of our insurance partners for a free, no-obligation quote.

9. Utilities: You are responsible for paying telephone, gas, water, and electricity accounts during your tenancy, as well as council tax. You must notify the relevant companies and the local authority when moving into or out of the property. You are also responsible for ensuring a valid television license is in place. Utility companies may require access for visits.

10. Taxation: If you pay rent directly to a landlord’s overseas bank account, you are responsible for applying the provisions of the HM Revenue and Customs Non-Resident Landlords scheme for taxing UK rental income. Please seek advice from us on this matter if applicable. These provisions do not apply if you are paying rent to Dipex Lettings and Management Limited.

11. Anti-Money Laundering Regulations: Dipex Lettings and Management Limited is subject to the Money Laundering Regulations 2007. We may ask you for suitable identification, and if we are unable to obtain this, we will be unable to proceed with any work on your behalf.

12. VAT: All charges levied by Dipex Lettings and Management Limited are subject to VAT at the prevailing rate of 20%.

13. Complaints Procedure: If you are dissatisfied with our service or handling of a transaction, please report the matter to the Partner/Manager of the Dipex Lettings and Management Limited office concerned. We will acknowledge your complaint within three working days and conduct an investigation. A formal written response will be provided within 15 working days.

If you are not satisfied with the resolution, please contact our Customer Service Officer. They will work with you to resolve the situation. Additionally, youmay refer the matter to The Property Ombudsman (TPO) within six months for a review. Please note that TPO will only review complaints made by consumers.

14. Amendments: Dipex Lettings and Management Limited reserves the right to change the schedule of fees and these terms of business. We will provide reasonable notice in writing regarding any changes.

By accepting these terms and conditions, you acknowledge that you have read, understood, and agree to abide by them. Failure to comply with these terms may result in penalties or other consequences as outlined herein.
